Terms of Service

By using MyTCGVault, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to access MyTCGVault LLC services.

2. Accounts

You are responsible for:

• Maintaining account security
• Providing accurate information
• All activity under your account

We may suspend accounts for violations.

3. Services Description

MyTCGVault provides digital tools to track, analyze, and manage trading card game collections. Features may change over time.

4. Subscriptions & Payments

Subscriptions may be offered through:

• Apple App Store
• Google Play
• Other authorized processors

Auto-renewing subscriptions renew unless canceled before renewal. Refunds are subject to platform rules.

5. User Content

You retain ownership of your content, including:

• Collection data
• Notes
• Profile images

By uploading content, you grant MyTCGVault a limited license to host, store, process, display, and use it solely to operate and improve the Services.

You represent that you have the right to upload your content.

6. Collection Sharing

If you choose to share your collection:

• Your username may be displayed.
• Your profile photo may be displayed.
• Shared content may be accessible by anyone with the link.

You are responsible for what you choose to share.

7. Acceptable Use

You agree not to:

• Reverse engineer the Services
• Interfere with security mechanisms
• Upload malware
• Use automated scraping tools without permission
• Infringe intellectual property rights
• Use the Services unlawfully

8. Intellectual Property

The Services, branding, and software are owned by MyTCGVault LLC. We grant a limited, revocable, non-transferable license for personal use.

9. No Financial, Investment, or Appraisal Advice

The Services provide tools, analytics, pricing estimates, and market-related information for informational and entertainment purposes only.

MyTCGVault:

• Is not a broker, dealer, financial advisor, investment advisor, appraiser, or marketplace.
• Does not provide financial, investment, tax, legal, or appraisal advice.
• Does not guarantee the accuracy, completeness, timeliness, or reliability of pricing data or analytics.
• Does not guarantee future market performance or asset value.

Trading card values are volatile and may fluctuate significantly due to market conditions, grading outcomes, supply changes, or third-party marketplace activity.

You acknowledge and agree that:

• Any decisions to buy, sell, trade, grade, insure, or otherwise transact in trading cards are made solely at your own risk.
• You are solely responsible for evaluating the accuracy and usefulness of any information provided through the Services.
• You should conduct your own independent research and, where appropriate, consult qualified professionals before making financial decisions.

You agree that MyTCGVault shall not be responsible for any financial losses, lost profits, lost opportunities, or market-based losses arising from your reliance on the Services.

10. Disclaimer of Warranties

The Services and all data provided through them are provided "as is" and "as available."

To the maximum extent permitted by law, MyTCGVault disclaims all warranties, express or implied, including:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of data
• Continuity or availability of service
• Error-free or uninterrupted operation

We do not warrant that pricing data, analytics, or market insights will be accurate, complete, current, or suitable for any particular purpose.

11. Limitation of Liability

To the maximum extent permitted by law:

In no event shall MyTCGVault or its officers, directors, members, employees, or agents be liable for:

• Any indirect, incidental, special, consequential, exemplary, or punitive damages;
• Any loss of profits, revenue, data, goodwill, or business opportunity;
• Any financial or market losses;
• Any losses arising from reliance on pricing data or analytics;
• Any errors or omissions in market data;
• Any third-party actions or marketplace transactions.

This limitation applies even if MyTCGVault has been advised of the possibility of such damages.

Except where prohibited by law, MyTCGVault's total aggregate liability for any claim arising out of or relating to the Services shall not exceed the greater of:

• (a) One hundred U.S. dollars ($100), or
• (b) The total amount you paid to MyTCGVault in the twelve (12) months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify MyTCGVault from claims arising from:

• Your use of the Services
• Your content
• Your violation of these Terms

13. Dispute Resolution & Arbitration

Informal Resolution

You agree to contact support@mytcgvault.com before filing a claim. We will attempt informal resolution within 30 days.

Binding Arbitration

Except for small claims or IP-related injunctions, disputes will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration will take place in Santa Clara County, California, unless conducted remotely.

Class Action Waiver

Disputes must be brought individually, not as part of a class action.

Opt-Out

You may opt out of arbitration within 30 days of accepting these Terms by emailing support@mytcgvault.com with subject line "Arbitration Opt-Out."

14. Governing Law

These Terms are governed by the laws of the State of California.

15. Changes to Terms

We may modify these Terms. Continued use after updates constitutes acceptance.
